UK health regulator defeated in landmark legal case
The British Dental Association (BDA) defeated the General Dental Council (GDC) in a landmark legal case during December. The GDC was found to have acted unlawfully during a consultation which proposed a 64 per cent annual retention fee rise for all UK dentists.
The BDA argued the consultation did not adequately explain the financial reasons for the fee increase and that key information was lacking. However, the judge declined to reverse the actual fee rise, as the GDC’s counsel cited the potential risk of “administrative chaos” at the regulator.
